The Federal Bureau of Investigation (FBI) is authorized to acquire, preserve, and exchange fingerprints and associated information under 28 U.S.C. section 534. Depending on the nature of your application, supplemental authorities include Federal statutes, State statutes pursuant to Public Law 92-544, Presidential Executive Orders, and federal regulations. All users are required to provide the reason for all fingerprint-based transactions. There is an obligation to ensure requests for Criminal History Record Information are being conducted for only authorized purposes prior to the submission of the request to the FBI. Therefore, if the reason for the fingerprint-based transaction is licensure certification or registration, an application must have already been submitted to the board.
